Kansas State Setoff Program

At the May 2007 Council Meeting, the City Council approved to participate in the Kansas State Setoff Program. The State setoff program is one of the best ways to receive past due payments from citizens who have left the City without paying a city utility bill.  The only requirements for submitting debts to the program are:

  • The debt amount must exceed $25

  • Debtor's name and social security number

  • A brief description of the debt and the amount of debt owed

  • Valid proof that 3 attempts have been made to collect the debt

Once a debt has been submitted, it is entered into the Kansas Debt Recovery System (KDRS) and payments are matched with Income Taxes, Unclaimed Property, Payroll (for state employees) and other miscellaneous returns, as they become available. 

Collection Fee

There is a collection fee for utilizing this program.  If the debt is sent in via email with a social security number the collection fee is 18.4%.  If the debt is sent in via postal mail and/or without a  social security number for that citizen, the fee is 23.4%. 

Once a debt has been submitted, it stays in the KDR System until the debt has been matched (so some of the debts could take a while to match!)  

Utility Service Card

To receive the maximum debt collection as possible, the City is required to submit a social security number along with the amount of debt.  Therefore, the City Council has agreed to require NEW citizens to fill out a Utility Service Card.  Existing citizens are not required to fill out a utility service card, but are definitely welcome to if they would like.  The Utility Service Card requests a social security number, therefore will remain in the locked safe, so no one else will see the card besides the City Clerk.  If a utility service customer does not feel comfortable providing his or her social security number, a $300 deposit can be made in lieu of providing the social security number.  The information provided on the Utility Service Card will only be used to collect debts through the setoff program.  Ample notice will be given before a debt is submitted.
